Terms of Service

Fair terms, plain English.

We know nobody enjoys reading terms of service. So we wrote ours to be as clear and fair as possible. No gotchas, no traps.

The short version

  • Use Switch responsibly. Don't use it to harm others or break the law.
  • Your data is yours. We don't claim ownership of your content or traffic data.
  • You can cancel anytime. No lock-in, no penalty. Your data gets deleted.
  • We can change these terms but we'll give you 30 days' notice for anything material.
  • We limit our liability to the fees you've paid us in the last 12 months. That's standard and fair.

Acceptance of terms

By using Switch, you agree to these terms.

By accessing or using Switch (the “Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is operated by Switch (“we,” “us,” or “our”) and available at switchtheweb.com.

If you're using Switch on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. “You” then refers to that organization.

If you don't agree with these Terms, don't use the Service. We don't want anyone stuck in an agreement they didn't choose.

Account terms

Keep your account secure. You're responsible for what happens under it.

  1. You are responsible for maintaining the security of your account and password. Switch cannot and will not be liable for any loss or damage from your failure to keep your credentials secure. We strongly recommend enabling two-factor authentication.
  2. You are responsible for all content posted and activity that occurs under your account, including content and activity by team members you invite.
  3. You must be a human. Accounts registered by bots or automated methods are not permitted.
  4. You must be at least 16 years old to use the Service.
  5. You must provide accurate information during registration and keep it up to date.

Payment, billing, and plan changes

Free means free. Paid means fair billing with no surprises.

  1. If you are using a free version of Switch, it is genuinely free: we do not ask for your credit card, and we do not sell your data. Free customers get the same privacy protections as paid customers.
  2. For paid plans, you will be billed in advance on a monthly or annual basis as selected during signup. Your subscription automatically renews unless you cancel before the renewal date.
  3. All fees are exclusive of taxes. Where required by law, we will collect applicable taxes (sales tax, VAT, GST) on top of the listed price.
  4. We reserve the right to change pricing. If we do, we will give you at least 30 days' notice before the new price takes effect. If you don't agree, you can cancel before the change.
  5. All payments are processed by Stripe. We never see or store your full credit card number.

Cancellation and termination

You can leave anytime. We'll delete your data.

  1. You can cancel your account at any time from the dashboard. An email request also works — just contact us and we'll handle it.
  2. Upon cancellation, your account and all associated traffic data become inaccessible immediately. Within 30 days, all data is permanently deleted from active systems. Within 60 days, all data is permanently deleted from backups. This is not reversible.
  3. If you cancel before the end of your paid billing period, your cancellation takes effect immediately. We do not prorate unused time, but we will not charge you again.
  4. We reserve the right to suspend or terminate your account if you violate these Terms. We will always try to reach out first unless the violation is severe (e.g., using Switch for illegal activity).

Acceptable use

Don't use Switch to harm others.

You agree not to use Switch to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Harass, abuse, or threaten others
  • Transmit malware, viruses, or any destructive code
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service for other users
  • Scrape, copy, or redistribute the Service or its content without permission
  • Misrepresent your identity or affiliation

We don't monitor your usage proactively, but if we learn about a violation, we may suspend or terminate your account. We'll explain why.

Intellectual property and content ownership

Your data is yours. Switch is ours. Pretty straightforward.

  1. Your data is yours. We claim no ownership over any content you submit, upload, or generate through the Service. This includes your site's traffic data, workflow configurations, and any other content associated with your account.
  2. Switch is ours. The Service, including its design, code, features, documentation, and branding, is owned by Switch and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
  3. Limited license. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms and your chosen plan.
  4. Feedback. If you send us ideas, suggestions, or feedback about the Service, we may use them without obligation to you. We appreciate feedback — it makes Switch better — but we don't want either of us to have to worry about IP issues when a suggestion turns into a feature.

Privacy and data

We have a separate, detailed privacy policy. Here's the gist.

Your privacy matters to us. Our full Privacy Policy explains in detail what data we collect, how we use it, and how we protect it.

Key points:

  • We collect no personal information from your site visitors
  • We set zero cookies
  • Raw IP addresses are never stored (hashed before any write)
  • We never sell data to anyone
  • Aggregate, anonymous agent statistics are published in our Agent Directory

Service availability

We do our best. We don't guarantee 100% uptime.

We take uptime seriously and work hard to keep Switch running smoothly. But the Service is provided on an “as is” and “as available” basis. We do not offer a formal SLA at this time.

We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers and impacts system performance. We'll always try to reach out before taking action.

We may modify or discontinue parts of the Service with reasonable notice. We will not remove core functionality without giving you time to adjust or export your data.

Limitation of liability

Our liability is capped at what you've paid us. This is standard.

Legal language (required)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWITCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (C) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID US ANYTHING, OUR LIABILITY IS LIMITED TO $50 USD.

In plain English: if things go wrong, the most we'll owe you is what you've paid us in the last year. This protects both of us and is standard for SaaS services.

Warranty disclaimer

We work hard to build a great product. But we can't guarantee perfection.

Legal language (required)

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SWITCH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We design Switch with care, test extensively, and fix bugs as fast as we can. But software is software — we can't promise perfection. If you find a bug, let us know and we'll prioritize fixing it.

Dispute resolution

Let's talk first. If that fails, courts in Delaware.

If you have a dispute with us, we want to resolve it quickly and fairly. Here is how:

  1. Talk to us first. Email legal@switchtheweb.com and describe the issue. We'll try to resolve it within 30 days.
  2. Mediation. If informal resolution doesn't work, either party may propose mediation. We'll split the cost.
  3. Litigation. If mediation fails, either party may bring a claim in the state or federal courts located in the State of Delaware, United States. Both parties consent to the exclusive jurisdiction of these courts.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

No forced arbitration. We do not require binding arbitration. We do not include a class action waiver. If you have a legitimate grievance, we believe you should have access to the legal system.

Changes to these terms

We'll give you 30 days' notice for material changes.

We may update these Terms from time to time. When we make material changes:

  • We will update the “last updated” date at the top
  • We will notify you by email at least 30 days before changes take effect
  • We will post a notice on the Switch dashboard

Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with a change, you can cancel your account before it takes effect.

General provisions

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Switch.
  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce a right or provision does not constitute a waiver of that right.
  • Assignment. You may not assign your rights under these Terms without our consent. We may assign ours in connection with a merger, acquisition, or sale of assets.
