By using Switch, you agree to these terms.
By accessing or using Switch (the “Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is operated by Switch (“we,” “us,” or “our”) and available at switchtheweb.com.
If you're using Switch on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. “You” then refers to that organization.
If you don't agree with these Terms, don't use the Service. We don't want anyone stuck in an agreement they didn't choose.
Keep your account secure. You're responsible for what happens under it.
Free means free. Paid means fair billing with no surprises.
You can leave anytime. We'll delete your data.
Don't use Switch to harm others.

We don't monitor your usage proactively, but if we learn about a violation, we may suspend or terminate your account. We'll explain why.
Your data is yours. Switch is ours. Pretty straightforward.

We do our best. We don't guarantee 100% uptime.
We take uptime seriously and work hard to keep Switch running smoothly. But the Service is provided on an “as is” and “as available” basis. We do not offer a formal SLA at this time.
We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers and impacts system performance. We'll always try to reach out before taking action.
We may modify or discontinue parts of the Service with reasonable notice. We will not remove core functionality without giving you time to adjust or export your data.
Our liability is capped at what you've paid us. This is standard.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWITCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (C) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID US ANYTHING, OUR LIABILITY IS LIMITED TO $50 USD.
In plain English: if things go wrong, the most we'll owe you is what you've paid us in the last year. This protects both of us and is standard for SaaS services.
We work hard to build a great product. But we can't guarantee perfection.

SWITCH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
We design Switch with care, test extensively, and fix bugs as fast as we can. But software is software — we can't promise perfection. If you find a bug, let us know and we'll prioritize fixing it.

If you have a dispute with us, we want to resolve it quickly and fairly. Here is how:
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
No forced arbitration. We do not require binding arbitration. We do not include a class action waiver. If you have a legitimate grievance, we believe you should have access to the legal system.
We'll give you 30 days' notice for material changes.
We may update these Terms from time to time. When we make material changes:
Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with a change, you can cancel your account before it takes effect.
